Sunshine Studio Event Policy, Liability Waiver & Participation Agreement

1. Agreement to Terms

By registering for, purchasing tickets to, attending, or participating in any event, class, workshop, gathering, wellness activity, art activity, or private function hosted at The Sunshine Studio (“Event”), all participants (“Participants”) acknowledge that they have read, understood, and voluntarily agreed to the following policies, terms, and conditions.

Participants further acknowledge that The Sunshine Studio is operated on privately owned property and that attendance is voluntary and at the Participant’s own risk.

2. Assumption of Risk

Participants understand and acknowledge that participation in events and activities may involve inherent risks, including but not limited to:

• Slips, trips, and falls

• Physical exertion or fatigue

• Allergic reactions

• Injury from use of equipment, art materials, furniture, décor, or wellness-related activities

• Exposure to weather conditions for indoor/outdoor events

• Interactions with other attendees

• Accidental property damage or personal injury

Participants voluntarily assume all risks associated with attendance and participation, whether foreseeable or unforeseeable.

Participants are responsible for determining whether they are physically, mentally, and medically able to safely participate in activities.

3. Release of Liability

To the fullest extent permitted by law, Participants release, waive, discharge, and hold harmless The Sunshine Studio, the property owner, event organizers, employees, volunteers, contractors, instructors, assistants, and affiliates from any and all liability, claims, demands, damages, losses, expenses, injuries, illnesses, or causes of action arising from or related to participation in any Event.

This release includes, but is not limited to:

• Personal injury

• Property loss or theft

• Accidents

• Dissatisfaction with the Event experience

• Emotional distress

• Food-related reactions or sensitivities

• Acts of other participants

• Weather-related interruptions

• Cancellations or schedule changes

Participants agree not to hold The Sunshine Studio or property owners financially or legally responsible except in cases of gross negligence or intentional misconduct where required by law.

4. Personal Responsibility

Participants agree to:

• Follow all posted rules and verbal instructions

• Use equipment and materials responsibly

• Respect the property, hosts, neighbors, and other attendees

• Supervise any children in their care at all times

• Notify organizers of any hazards, injuries, or concerns immediately

• Refrain from participating while under the influence of drugs or alcohol that may impair judgment or safety

Participants may be removed from the Event without refund for unsafe, disruptive, abusive, illegal, or disrespectful behavior.

5. Health & Wellness Disclaimer

The Sunshine Studio may host wellness, movement, mindfulness, creative, or educational activities. These activities are not medical treatment, physical therapy, mental health counseling, or licensed healthcare services unless explicitly stated.

Participants should consult a qualified healthcare professional regarding any medical concerns before participating.

Participation is voluntary, and Participants accept full responsibility for their own health and wellbeing.

6. Property Damage

Participants are financially responsible for any intentional or negligent damage they cause to the property, furnishings, equipment, décor, supplies, or surrounding areas during the Event.

7. No Guarantees / Satisfaction Disclaimer

The Sunshine Studio strives to provide a positive, welcoming, and enjoyable experience. However, individual experiences may vary.

By attending, Participants acknowledge that:

• Results, experiences, or outcomes are subjective

• No guarantees are made regarding personal satisfaction, emotional outcomes, networking opportunities, artistic results, or wellness benefits

• Refunds will not be issued due to personal dissatisfaction unless otherwise stated in a specific event refund policy

8. Food, Allergies & Sensitivities

Participants acknowledge that food, beverages, art supplies, fragrances, essential oils, plants, pets, or environmental allergens may be present.

The Sunshine Studio cannot guarantee an allergen-free environment.

Participants are responsible for managing their own allergies, sensitivities, and dietary needs.

9. Photography & Media Release

Unless a Participant notifies organizers in writing prior to the Event, Participants grant permission for photographs, video recordings, or audio recordings taken during Events to be used for promotional, marketing, educational, and social media purposes without compensation.

Participants who prefer not to appear in media should notify the Event organizer before the Event begins.

10. Children & Minors

Parents or legal guardians are fully responsible for supervising minors attending Events.

By permitting a minor to attend, the parent or guardian agrees to all terms in this Agreement on behalf of the minor.

11. Cancellations, Rescheduling & Force Majeure

The Sunshine Studio reserves the right to:

• Modify Event schedules

• Substitute instructors or activities

• Cancel or postpone Events

• Refuse admission when necessary for safety or operational reasons

The Sunshine Studio shall not be liable for cancellations, delays, interruptions, or modifications caused by weather, emergencies, illness, utility failures, government actions, natural disasters, or circumstances beyond reasonable control.

Refunds, credits, or transfers are provided solely at the discretion of the Event organizer unless otherwise required by law.

12. Emergency Medical Care

In the event of an emergency, Participants authorize Event organizers to seek emergency medical assistance if deemed necessary.

Participants acknowledge responsibility for any medical expenses incurred.

13. Indemnification

Participants agree to indemnify and hold harmless The Sunshine Studio and associated parties from any claims, damages, liabilities, costs, or legal expenses arising from:

• Their own actions or negligence

• Violations of these policies

• Damage caused to persons or property

• Claims brought by guests, minors, or third parties connected to the Participant
